Terms of Use
What you can expect from Blurami, and what it expects from you.
Working draft – Alpha / in development
Blurami is currently in active development and is not yet publicly available on the Apple App Store. Some features may be available only to developers or testers. Features, technical processes and scope may change before public release.
This version describes the current state of development. Features that are planned but not yet implemented are not described as existing features.
This English version is a translation of the German original (Nutzungsbedingungen). In case of discrepancies, the German version prevails to the extent permitted by applicable law.
These Terms of Use govern the use of Blurami. By creating a NubisMedia account or otherwise accepting these Terms of Use, you agree to them. If you use Blurami on behalf of an organisation, you are responsible for being authorised to do so.
1. The Blurami service
Blurami is an app for protecting privacy and editing photos and provides manual, assisted and automated tools. You can edit image areas yourself using freehand, masking, pixelation, blur or other available tools. You can also specify that a particular edit is applied to a selected subject, for example a type of pixelation you have chosen for a particular person. Blurami can attempt to recognise this subject in further selected photos and apply your edit.
Blurami is intended primarily for private users who want to check and edit their own photos before sharing or publishing them. Professional or organisational use is not excluded; in that case you are yourself responsible for complying with the additional legal requirements that apply to your use.
You decide which subject is edited or protected and how. Blurami supports you with the technical implementation.
Blurami does not need to know the real identity for this. Subjects may receive
internal identifiers such as M1234T; you can optionally assign your own names or
labels. Features depend on device and plan.
2. Guest, Basic, Pro and Ultra
Guest does not require an account. Basic is free of charge. Pro and Ultra are paid plans with additional features or higher limits. Current features, limits and prices are shown in the app or on the website. Changes for future subscription periods are made in accordance with the statutory requirements.
3. Your account and minimum age
You must be at least 16 years old to use a NubisMedia account. You can use Guest mode without a NubisMedia account, provided that your device and its parental-control settings (such as Screen Time or Family Sharing) allow it.
Sign in with Apple creates a NubisMedia account: a shared account for the NubisMedia apps, with a separate membership for each app. Details are in the Privacy Policy.
You are responsible for reasonably protecting your account and device. In particular, unauthorised account access, circumvention of security measures or limits, deliberate interference with the service, automated or excessive use that endangers security, and unlawful use are not permitted. If you suspect your account has been compromised, you should contact us as soon as possible.
4. Your photos and the rights of other people
You decide which photos you use and remain responsible for their use, editing, export, sharing and publication. If photos show other people, you are responsible for having the necessary rights and legal bases. This applies in particular to professional or organisational use, for example by photographers, companies, schools, childcare facilities or clubs. Blurami does not give you any rights you do not already have.
5. Prohibited use and responsibility for content
Blurami is intended for editing and protecting photos. You are responsible for the content you process using Blurami and for ensuring that your use of such content complies with applicable law. You must not use Blurami to:
- create or distribute unlawful content or facilitate unlawful activities;
- create, edit or distribute child sexual abuse material or other unlawful depictions of sexual violence;
- threaten or deliberately harass other people or violate their privacy or personality rights;
- use content in a manner that infringes copyright, trademark rights, data protection rights or other third-party rights;
- promote unlawful discrimination, violence or hatred against other people;
- circumvent Blurami's security mechanisms, usage restrictions or technical safeguards.
This list is not exhaustive. Other unlawful uses or uses that violate these Terms are also prohibited.
Publishing and sharing. You decide whether and where to publish your edited images or share them with others. You are responsible for ensuring that you have the necessary rights and, where required, consent to do so.
Editing, pixelating or obscuring an image using Blurami does not constitute confirmation that the resulting image may lawfully be used or published.
No general content monitoring. Blurami is not a public platform for publishing user content. We do not review or moderate photos stored locally on your device and do not have general access to such content.
Where we receive specific indications of misuse or unlawful use of our online services, we may take the measures described in the section "Suspension and termination", to the extent permitted by applicable law.
6. Detection and recognition of subjects
Blurami can recognise subjects across selected photos so that your editing or
protection rules are applied consistently. Blurami does not decide who should be
protected; you do. Recognition does not mean that Blurami knows the real
identity. For example, M1234T may be associated with several images without
Blurami knowing who the person is. Details are in the Privacy
Policy.
7. Exporting, sharing and publishing
Blurami does not publish your photos on its own. When exporting or sharing, you determine the recipient or destination. You are responsible for checking whether the result is suitable for your purpose and whether you may share or publish it.
The provisions on prohibited use and responsibility for content also apply.
8. Cloud services
To the extent your plan provides for it and the function is available, you can connect supported cloud storage services. These are separate services of the respective providers. Changing or ending your Blurami subscription does not automatically delete files stored there. Data protection details are in our Privacy Policy.
9. Subscriptions and payment
Subscriptions purchased through the Apple App Store are billed and managed by Apple. Price, term and renewal conditions are shown before purchase. Subscriptions may renew automatically under Apple's terms unless you cancel them through Apple. Statutory refund rights and Apple's applicable rules remain unaffected.
10. Plan changes and expiry
If Pro or Ultra ends, your account reverts to Basic unless another plan is active. A plan change does not delete any photos, projects or profiles. Content within the new limits remains usable. Existing content above the limits may remain accessible read-only; you can view, export or delete it, but not modify it with features that are no longer included. Your own cloud files are not deleted as a result.
11. Deleting your account
You can leave Blurami or delete your NubisMedia account for all apps (see Privacy Policy). Deletion does not end an active subscription purchased through Apple. You must cancel it separately in your Apple subscription settings. We recommend cancelling before deleting your account. Deleting your account does not automatically give rise to a refund claim; statutory rights and Apple's rules remain unaffected.
Deleting your account does not automatically delete local photos, projects or other content on your device, nor any files with your own cloud providers. Data protection details are in our Privacy Policy. Afterwards you can use Blurami as a guest or create a new account later.
12. Suspension and termination
We may temporarily restrict or suspend accounts or individual online services where this is reasonably necessary to protect the account, users, systems or the service. Reasons may include compromised accounts or unauthorised access, circumvention of security measures or limits, misuse, automated/excessive use endangering security, legal violations or misuse of current or future online services, including AI features.
Where appropriate, we may require you to secure the account or stop the activity concerned. In the event of serious or repeated violations, we may terminate the account and the contractual relationship for good cause. Legally required notices or opportunities to remedy will be given; in the case of significant security risks, unauthorised access or serious misuse, immediate action may be justified.
Suspension or termination of the account does not automatically end an App Store subscription. It must be managed separately through Apple. Statutory termination rights remain unaffected.
13. Human review and quality of results
Blurami is an assistive tool. Blurami is designed for use with human review ("human in the loop"). With manual tools, you determine the areas to be edited. With subject-based or automated functions, you determine the subject and the edit to be applied; Blurami supports detection and application.
You are responsible for the final review before you rely on a result, export, share or publish it.
Detection and processing may be impaired by low resolution or compression; poor or unusual lighting; shadows, backlight or contrast; motion blur; small, distant or partially visible subjects; unusual angles; glasses or sunglasses; masks; hats or helmets; hair, hands, objects or people covering a subject; reflections in mirrors, windows, water or reflective surfaces; photos or pictures within photos; posters; displays, televisions, smartphones or other screens; duplicates; rotated, cropped or edited images; AI-generated or synthetic images; AI-modified or augmented images; and other ambiguous circumstances.
Blurami may detect an apparent face, person, animal or other subject in reflections, photos, posters, screens or AI-generated/synthetic images even though no real subject is shown. Conversely, real or artificial subjects may be missed or incorrectly assigned. A detection does not mean that a real person or object exists or that Blurami has established its identity.
Blurami cannot reliably reconstruct information that is not sufficiently present in the source material. There is no guarantee that every subject will be detected, correctly assigned, obscured, pixelated, removed or otherwise processed correctly. Automated processes can produce false negatives and false positives. Even an edit that has been technically carried out may not meet your expectations because of the source material.
The final assessment is yours, in particular where a person must be made unrecognisable for data protection, privacy or personality rights, contractual or other legal reasons.
14. Your data and backups
Blurami may create, modify or delete app data when you use corresponding functions, such as deleting a project or profile. Blurami is not a backup service. You are responsible for appropriate backups of important photos and data. Deletions may be permanent.
Original photos generally remain in your photo library and are not modified by normal Blurami editing. Should a future function expressly change or delete content outside the Blurami workspace, this must be apparent. Files with third-party providers are additionally subject to their synchronisation, availability and deletion behaviour.
15. Third-party services
Functions may depend on Apple, Google, Microsoft or other cloud, software and operating-system providers. We do not control their continued availability or changes. Providers may change or discontinue services, interfaces, permissions or operating-system functions. Where reasonably possible, we adapt Blurami; we cannot guarantee that dependent functions will remain permanently available unchanged.
16. Availability and changes
We strive for reliable and secure operation. Software may contain errors and services may fail. We do not guarantee uninterrupted operation or error-free functioning on every device, OS version or configuration. Functions may require certain devices or capabilities. We may update Blurami, fix errors, improve security and further develop or change features. Mandatory consumer rights remain unaffected.
17. Liability
We are liable without limitation to the extent required by law, in particular for intent, gross negligence and damage resulting from injury to life, body or health. In the case of simple negligence, we are liable for breaches of essential contractual obligations, the fulfilment of which makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely; liability is then limited to foreseeable damage typical for the contract. Otherwise, liability for simple negligence is excluded to the extent permitted by law. Mandatory liability and consumer rights remain unaffected. Notices on human review and the limits of automated processes do not restrict mandatory rights.
18. Intellectual property and your images
Blurami as well as its software, trademark, user interface, design and other protected components remain the property of their respective rights holders.
Your source images. Blurami does not claim any ownership, copyright or other rights in images you process. Your existing rights remain with you. Blurami does not give you any rights in third-party material.
Your edits. You determine manual, assisted and automated edits, such as freehand masking, pixelation or subject-based editing. Using these tools does not transfer any rights in your images to Blurami.
Images edited or created with Blurami. Blurami does not claim any ownership, copyright or exclusive rights of use in your results. To the extent rights arise and belong to you under applicable law, they remain with you. Blurami does not claim additional rights merely because manual, automated or AI-assisted functions were involved. Whether a result is protected by copyright or otherwise depends on the applicable law and the circumstances of its creation.
Third-party rights remain. Editing does not automatically remove copyright, trademark, personality, data protection or other rights of third parties. You are responsible for the rights required for use, editing, sharing or publication.
No commercial use of your images by Blurami. Except as technically necessary to provide a function you have expressly chosen, these Terms do not grant Blurami any licence to use your photos or results commercially. In particular, we do not claim any right to use them for advertising, sell them to third parties or use them to train general AI/machine-learning models.
19. Data protection
The processing of personal data is described separately in the Blurami Privacy Policy, in particular account data, local photo and subject processing, facial and recognition data, Google ML Kit, cloud services, account deletion and data protection rights.
20. Changes to these Terms of Use
We may update these Terms in the event of changes to Blurami, services or the legal situation. If renewed acceptance is required, we will ask for it before the new version applies. Acceptance records are stored as described in the Privacy Policy.
21. Applicable law and dispute resolution
German law applies. If you are a consumer, the mandatory protective provisions of the country in which you live remain unaffected.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
